Whether you’re drafting a Marital Dissolution Agreement, Agreed Order or Agreed Parenting Plan, specificity can be your friend. Although you and your ex may currently be getting along, and you believe that it is sufficient to agree to “alternate holidays with the children” or to “split retirement accounts”, there may be disagreement later over what that means. Many clients don’t want to hear that more is required when drafting their agreement, but those same clients are thankful for the details when there is a disagreement later. Being specific ensures that everyone is really on the same page and that there are no differences in interpretation. Be sure to spell out when holiday time begins, when summer parenting time ends, which year each parent claims the children for taxes, etc. These details will serve you well in the future.
