Uncontested divorces may be the fastest and cheapest way to finalize a divorce. However, you can only file an uncontested divorce if you and your spouse are able to reach an agreement on all issues related to parenting time, child support, spousal support, property division, and debt division.
If you decide to hire Ms. Castles to guide you through your uncontested divorce, our office will do the following things on your behalf:
- Provide you with all paperwork to fill out so that our office can begin drafting the necessary divorce documents.
- Draft a Complaint for Divorce
- Draft a Marital Dissolution Agreement, addressing the division of all assets and debts
- Draft an Agreed Parenting Plan
- Draft a Health Insurance Notice, which is required by the state of Tennessee
- Draft affidavits for both parties to sign
- Prepare your Final Decree and Certificate of Divorce for the court
- File all documents with the court
- Attend your final divorce hearing and prepare you for that hearing
To truly file an uncontested divorce, you and your spouse need to agree on all issues related to the divorce, including financial and parenting issues. This agreement goes beyond the mere agreement to obtain a divorce.
A Tennessee divorce requires that your divorce complaint be on file with the court for a minimum of sixty (60) days prior to being finalized if you do not have minor children and a minimum of ninety (90) days if minor children are involved. A few counties will grant the divorce after this waiting period without the necessity of a court hearing. Contact our office today to determine whether your case qualifies for that process.
